District Court Bars FTC’s Application of Red Flag Rules to Attorneys

In a recent ruling by the U.S. District Court for the District of Columbia the FTC's Red Flag Rules were held to be inapplicable to lawyers. The Red Flag Rules would require awyers to identify, detect and respond to relevant patterns, practices, and specific forms of activity that are “red flags,” signaling possible identify theft. This is simply another hidden tax on consumers that would have increased the cost of legal services unnecessarily.
